Terms of Service

Article 1 – Definitions

In these Terms of Service, the following definitions apply:

Cooling-off period:
The period during which the consumer may exercise the right of withdrawal.

Consumer:
A natural person who does not act in the course of a business or profession and enters into a distance contract with the entrepreneur.

Day:
Calendar day.

Ongoing transaction:
A distance contract relating to a series of products and/or services, where delivery and/or purchase obligations are spread over time.

Durable data carrier:
Any medium that enables the consumer or entrepreneur to store information addressed personally to them in a way that allows future access and unchanged reproduction.

Right of withdrawal:
The consumer’s right to cancel the distance contract within the cooling-off period.

Entrepreneur:
The natural or legal person offering products and/or services to consumers at a distance.

Distance contract:
A contract concluded within the framework of an organized system for distance selling, where only one or more means of distance communication are used up to and including the conclusion of the contract.

Means of distance communication:
Any means that can be used to conclude a contract without the consumer and entrepreneur being physically present together.

Terms of Service:
These Terms of Service of the entrepreneur.

Article 3 – Applicability

These Terms of Service apply to every offer made by the entrepreneur and to every distance contract and order concluded between the entrepreneur and the consumer.

Before the distance contract is concluded, the text of these Terms of Service will be made available to the consumer. If this is not reasonably possible, it will be indicated where the Terms can be consulted and that they will be provided free of charge upon request.

If the contract is concluded electronically, the Terms of Service will be provided electronically in such a way that they can be easily stored on a durable data carrier.

If specific product or service conditions apply in addition to these Terms, the consumer may rely on the provision that is most favorable to them in case of conflict.

If any provision of these Terms is wholly or partially void or invalid, the remaining provisions remain in force and the invalid provision will be replaced with one that most closely reflects its intent.

Situations not covered by these Terms shall be assessed in accordance with the spirit of these Terms.


Article 4 – The Offer

If an offer has a limited validity period or is subject to conditions, this will be explicitly stated.

All offers are non-binding. The entrepreneur reserves the right to modify or withdraw offers.

Product descriptions are accurate and sufficiently detailed. Images are a truthful representation of products, but colors may vary depending on display settings.

Obvious errors or mistakes do not bind the entrepreneur.

Prices include VAT unless stated otherwise. Shipping costs, payment methods, delivery terms, withdrawal rights, and contract duration (where applicable) are clearly stated.


Article 5 – The Contract

The contract is concluded at the moment the consumer accepts the offer and meets the stated conditions.

Electronic acceptance will be confirmed electronically. Until confirmation is received, the consumer may cancel the contract.

The entrepreneur takes appropriate security measures for electronic data transfer and payments.

The entrepreneur may refuse an order or impose conditions if there are valid reasons related to payment or availability.

All contracts are subject to sufficient product availability.


Article 6 – Right of Withdrawal

Consumers may cancel the purchase of products within 14 days without giving any reason.
The cooling-off period starts the day after the product is received.

During this period, the consumer must handle the product and packaging with care and only use it to the extent necessary to assess the product.

To exercise the right of withdrawal, the consumer must notify the entrepreneur in writing (e.g. email) within 14 days and return the product within a further 14 days.

If these conditions are not met, the purchase becomes final.


Article 7 – Costs in Case of Withdrawal

If the consumer exercises the right of withdrawal, return shipping costs are borne by the consumer.

Refunds will be processed within 14 days after withdrawal, provided the product has been received or proof of return has been supplied.


Article 8 – Exclusion of the Right of Withdrawal

The right of withdrawal may be excluded for products:

  • Made according to consumer specifications

  • Clearly personalized

  • Not suitable for return due to their nature

  • Perishable or short-lived

  • Hygienic products with broken seals

  • Audio/video recordings or software with broken seals

And for services that have started with the consumer’s explicit consent before the cooling-off period expires.


Article 9 – Prices

Prices will not be increased during the offer period, except due to VAT changes.

Prices dependent on financial market fluctuations may vary.

All prices include VAT. Typographical errors do not entitle consumers to delivery at the incorrect price.


Article 10 – Conformity & Warranty

Products comply with the agreement, specifications, and legal requirements.

Manufacturer warranties do not affect statutory consumer rights.

Defects must be reported within 14 days of delivery. Returns must be in original condition and packaging.

Warranty does not apply in cases of misuse, improper handling, unauthorized repair, or external damage.


Article 11 – Delivery & Execution

Orders are processed with due care and delivered to the address provided by the consumer.

Delivery occurs within 30 days, unless otherwise agreed.

If delivery is delayed or incomplete, the consumer may cancel the contract and receive a refund.

Risk of loss or damage remains with the entrepreneur until delivery.


Article 12 – Ongoing Transactions

Consumers may cancel ongoing contracts at any time with a maximum notice period of one month.

Fixed-term contracts may not be automatically renewed unless permitted by law.

Contracts longer than one year may be terminated after one year with one month’s notice.


Article 13 – Payment

Unless otherwise agreed, payment must be made within 7 business days after the cooling-off period begins.

The consumer must report any payment inaccuracies immediately.

In case of non-payment, reasonable collection costs may be charged within legal limits.


Article 14 – Complaints Procedure

Complaints must be submitted within 7 days after discovery.

Complaints will be answered within 14 days. If more time is required, the consumer will be informed.

If unresolved, disputes may be submitted to a dispute resolution procedure.


Article 15 – Disputes & Governing Law

All agreements governed by these Terms are subject exclusively to Dutch law, even if the consumer resides abroad.
